Elevate Nursing LLC and its affiliate NurseCon LLC (collectively, “Elevate Nursing,” “we,” “us,” “our”) respect your privacy and value your trust. This Privacy Policy explains how the websites www.nursecon.com and nurseconevents.com, including links for Camp NurseCon (collectively, the “Sites”) collect and use the information of its users (“user” or “you” or “your”) that we may collect when you use our “Services” (using our Services means engaging with us via our Sites, purchasing products from us, planning and attending events associated with us, or using any other products or services we may provide now or in the future). For purposes of this Privacy Policy, “Personal Data” means any information that identifies or can be used to identify you or another individual, directly or indirectly. Examples of Personal Data include, but are not limited to, first and last name, email address, phone number, and occupation. Otherwise, any capitalized terms used but not defined in this Privacy Policy have the meanings given to them in our Terms of Use for each Site.

We may update or modify this Privacy Policy from time to time. If we make material changes, we will revise the “Last Updated” date above, and we may also choose to send you a notification of these changes. We encourage you to review this Privacy Policy frequently to stay informed about our privacy practices and how you can exercise your options related to those practices.

Your continued use of the Services will constitute your understanding and acknowledgment of this Privacy Policy. Furthermore, because some users of our Services are residents of states, provinces, countries, or regions that have data transfer restrictions (e.g., EU, UK, China, Quebec, Colorado), we now require the consent of all users for us to process your data in the United States.

1. What Information Do We Collect?

We may collect the following types of Personal Data about you:

Information You Provide to Us

We collect information that you provide to us when you use the Services, for example by purchasing products from us or contacting us directly with questions or feedback. This information may include:

  • Identifiers, such as your name, email address, telephone number, or physical address;

  • Purchase information, such as purchase date or purchase amount; or

  • User Generated Content, such as personal information you include in comments or survey responses.

Note that if you make purchases via our Sites, you may be required to provide financial information, such as your credit or debit card number, to our third-party payment processor. We do not collect or store such financial information and we are not responsible for the payment processor’s data collection or storage.

Information We Collect Automatically

We may automatically collect information about you when you access the Services, including:

  • Device information such as device model, operating system and version, unique device or personal identifiers, mobile network information, IP address, or browser type; or

  • Activity information such as when you accessed the Services, which pages you viewed, and which sites you visited before and after accessing the Services.

Information We Collect from Third Parties

We may collect information about you from third parties, for example, by allowing third parties to place their own cookies on the Sites that help us with measuring site traffic or analytics. The information collected and stored by these third parties is subject to their own privacy policies and practices. We currently work with third-party vendors that may collect your personal information and share it with us:

  • Advertising Service

  • Credit Card Processing

  • Reservation Management Software

  • Merchant Solutions

2. How Do We Use Your Information?

We may use the information and Personal Data we collect about you to serve the following purposes:

  • to provide the Services to you;

  • to facilitate your purchases from us;

  • to manage our relationship with you, including responding to your inquiries, providing you with notices, and requesting your feedback;

  • to administer promotions and events;

  • to market the Services to you;

  • to analyze your use of our Services;

  • to improve and enhance our Services;

  • to detect and protect against security incidents or fraudulent or unlawful activity;

  • to comply with legal and regulatory requirements; or

  • other purposes at your direction or with your consent.

3. Do We Disclose Your Information to Others?

We do not sell or rent your Personal Information. However, we may disclose your information to third parties as follows:

  • with our Service Providers (defined as those who work with us to provide our products and Services and assist us in security and fraud prevention, such as vendors, agents, and consultants) who need access to your information to perform Services on our behalf, such as web hosting, analytics, marketing, advertising, or e-commerce;

  • with our professional advisers, such as auditors, accountants, or lawyers;

  • in connection with the change to the control or financial status of Elevate Nursing LLC or NurseCon LLC, such as a merger, sale of our assets, financing, acquisition, or bankruptcy;

  • with our current and future affiliate companies;

  • to protect the legal rights, safety, or security of the Sites and our community, such as to enforce our Terms of Use;

  • to prevent fraudulent or unlawful activity;

  • to respond to a law enforcement or government authority request or other legal or regulatory process;

  • on an aggregated and anonymized basis; or

  • with other parties at your direction or with your consent.

4. What Are Your Rights Regarding Your Personal Data?

A. General regional rights

Access Rights: you may have the right to receive certain information, such as the following (these rights, and the applicable types of data and time periods, will vary depending on the laws applicable to the state or country in which you reside):

  • The categories of Personal Data we have collected or disclosed about you; the categories of sources of such information; the business or commercial purpose for collecting or selling your Personal Data; and the categories of third parties with whom we shared Personal Data.

  • Access to and/or a copy of certain Personal Data we hold about you.

  • In some circumstances, you may have the right to obtain certain Personal Data in a portable format.

Erasure: you may have the right to request that we delete certain Personal Data we have about you. We may either decide to delete your Personal Data entirely, or we may anonymize or aggregate your Personal Data such that it no longer reasonably identifies you. Certain Personal Data may be exempt from such requests under applicable law. For example, we need certain types of information so that we can provide our services to you, we may be required to retain certain information for legal purposes, and there may be other reasons we may need to keep certain Personal Data under various applicable laws. In addition, if you ask us to delete your Personal Data, you may no longer be able to access or use some of our Services.

Correction: you may have the right to request that we correct certain Personal Data we hold about you.

Limitation of Processing: Certain laws may allow you to object to or limit the manner in which we process some of your Personal Data, including the ways in which we use or share it. For example, you may have these rights if the processing was undertaken without your consent in connection with our legitimate business interests (although we may not be required to cease or limit processing in cases where our interests are balanced against your privacy interests).

Regulator Contact: You may have the right to contact or file a complaint with regulators or supervisory authorities about our processing of Personal Data. To do so, please contact your local data protection or consumer protection authority.

If you believe that you have specific rights under your jurisdiction and you would like to exercise any of these rights, please submit a support request through our Sites or email us at support@nursecon.com. Other than marketing opt-out and do-not-sell requests, you will be required to verify your identity before we fulfill your request. In certain jurisdictions, you may be able to designate an authorized agent to make a request on your behalf, subject to certain requirements of your applicable law. We may require that you provide the email address we have on file for you (and verify that you can access that email account) as well as an address, phone number, or other data we have on file, in order to verify your identity. If an agent is submitting the request on your behalf, we reserve the right to validate the agent’s authority to act on your behalf, and we may be required to take additional verification measures under applicable law.

B. European Union and United Kingdom users

If you are a user from the European Union or United Kingdom that restricts the transfer of your Personal Data to the United States, you should be aware that we are the controller of your Personal Data (Data Controller) under the EU General Data Protection Regulation (“GDPR”), the UK General Data Protection Regulation (“UK GDPR”), and such similar laws promulgated in the various countries. You may have certain additional rights regarding your Personal Data (as defined in the GDPR and UK GDPR, for instance), including the right to:

  • access your information;

  • rectify or amend your information if it is incorrect, incomplete, or misleading;

  • have your information erased (“right to be forgotten”) if certain grounds are met;

  • withdraw your consent to our processing of your information at any time, if our processing is based on consent;

  • object to our processing of your information, if our processing is based on legitimate interests;

  • object to our processing of your information for direct marketing purposes;

  • data portability by receiving your information from us in a structured, commonly used, machine-readable format and fit to be transmitted to another controller without hindrance from us.

  • lodge a complaint with your local data protection supervisory authority. However, we ask you to please attempt to resolve any issues with us before taking such measures.

  • not be subject to a decision based solely on automated processing.

  • Request details of the basis on which your Personal Data is transferred outside the European Economic Area (EEA), but you acknowledge that data transfer agreements may need to be partially redacted for reasons of commercial confidentiality. 

There is no charge for any of these requests. To make a request, please contact us at support@nursecon.com. We try to respond to such requests in a timely manner, but in no event longer than one month. When we collect your Personal Data, we maintain and store it for as long as we determine reasonably necessary to provide our Services to you, unless you exercise your right to erasure described above, or to comply with applicable legal requirements.

If you are a resident of the European Union or United Kingdom, when we process your Personal Data, we can only do so in the following situations:

  • You have provided a Data Processing Consent. However, you are able to remove your consent at any time, and you may do this by contacting us at support@nursecon.com;

  • When or if we ever register under the EU-US Data Privacy Framework;

  • We have a contractual obligation;

  • We have a legal obligation; or

  • We have a legitimate interest in processing your Personal Data. For example, we may process your Personal Data to send you marketing communications, relevant content, products, or to communicate with you about changes to our services, and to provide, secure, and improve our services; and

  • Response to your inquiries when you directly communicate with us.

At present, we collect and process your information only to fulfill a contractual obligation to you, to respond to your inquiries, or because we have a legitimate interest in processing your Personal Data. To that end, Personal Data you provide to us may be transferred out of the country in which you reside to servers in a country that may not guarantee the same level of protection as the one where you reside. We of course will take all steps reasonably necessary to ensure that your Personal Data is treated securely in accordance with this Privacy Policy, and no transfer of your Personal Data will take place to a third party unless there are adequate controls in place to protect your personal information.

When we collect your Personal Data, we maintain and store it for as long as we determine reasonably necessary to provide our Services to you, unless you exercise your right to erasure, or to comply with the applicable legal requirements. 

C. U.S. state-specific users

Various U.S. states provide specific rights to residents of the state regarding Personal Data, which includes allowing consumers in these states to opt out of certain sharing of their data or in Colorado where you must consent for us to process sensitive Personal Data or any data of children. 

Depending on where you reside, your state may have enacted privacy laws (e.g., California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia) that allow you to request Elevate Nursing LLC and NurseCon LLC to:

  • Disclose the sources, categories, and specific pieces of Personal Data we have collected about you, how that information is used, and with whom Elevate Nursing LLC and NurseCon LLC share it;

  • Disclose the purpose for collecting Personal Data;

  • Disclose the categories of third parties with whom Elevate Nursing LLC and NurseCon LLC share Personal Data;

  • Delete/rectify/restrict their Personal Data, subject to certain exceptions (right of rectification not applicable to Iowa and Utah residents);

  • Disclose, for any “sales” of Personal Data, the categories of Personal Data collected and sold and to what categories of third parties it was sold;

  • Opt-out of sales of your Personal Data (if any), certain processing of your Personal Data (opting out of the processing of Personal Data not applicable to Iowa residents) for profiling/targeted advertising purposes (including California Civil Code Section 1798.83 “Shine the Light” law), and subject certain Personal Data to automated decision-making algorithms (not applicable to Iowa or Utah residents);

  • Opt-in for sensitive data processing;

  • Provide a copy of your Personal Data in a readily usable format that allows the information to be transmitted to others, or a representative summary (only in Indiana CDPA);

  • Not discriminate you against for exercising any of the rights described above.

D. Canada users

If you are a user from Canada and its associated provinces, this privacy policy reflects our adherence to the Personal Information Protection and Electronic Documents Act (PIPEDA), the Personal Information Protection Act (PIPA), and the Act Respecting the Protection of Personal Information in the Private Sector, which governs the collection, use and disclosure of personal information in Canada, British Columbia, and Québec, respectively. Under PIPEDA, individuals have the right to access their personal information, request corrections, and inquire about our privacy practices. Under PIPA, consumers have the right to access their personal information held by us, request corrections to inaccurate information, and inquire about our privacy practices. The Act Respecting the Protection of Personal Information in the Private Sector specifically governs the collection, use, and disclosure of personal information by private sector organizations in Québec. Under this law, individuals have the right to access their personal information, request corrections, and inquire about our privacy practices.

Please be aware, we transfer information to our affiliates and subsidiaries and to other parties as described in this Privacy Policy, across international borders, and from your country or jurisdiction to other countries and jurisdictions around the world, including to the United States. As a result, your personal information may be transferred to, stored and/or processed in such other countries, including on servers located in such other countries.

If you are a Quebec resident, this means that your personal information may be transferred outside of Quebec. This also means your personal information may be transferred to or disclosed to service providers located outside of Quebec.

Your use of the Sites/Services or provision of any information to us therefore constitutes your consent to the transfer to and from, processing, usage, sharing, and storage of information about you in other regions with laws governing data collection and use that may differ from your region’s data protection laws.

E. India users

Data privacy and protection in India is currently regulated by the Information Technology Act, 2000 (IT Act 200), along with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 (SPDI Rules). However, since August 2023, Parliament has passed the Digital Personal Data Protection Act (DPDPA). Although not yet in force, this policy aims to both comply with the current legislation in force and in anticipation of the DPDPA. If you are a user from India, you should be aware that we are the data fiduciary and data processor. As the data fiduciary and processor, we collect your Personal Data. In this context, Personal Data includes any data collected in digital form and personal data collected or stored in a non-digital form that is subsequently digitized. Personal Data that is made publicly available by you is out of the scope of the associated legislation.

Your rights include the right to access, correct, complete, or update, any Personal Data that may be deemed to be inaccurate, misleading, or incomplete. You have the right to be informed according to and upon your request, which includes but is not limited to, details regarding a summary of the Personal Data that is being processed and processing activities being undertaken. You have the right to request an erasure of Personal Data, unless retention of the same is necessary for the specified purpose or for compliance with any law for the time being in force. You have the right to withdraw consent at any time. You have the right to a grievance redressal mechanism through us so that we may resolve any grievances internally. You are obliged to exhaust the opportunity for grievance redressal with us before invoking your right to approach the Data Protection Board for grievances. Your have the right to nominate any other individual who can exercise rights in relation to your Personal Data in the event of your death or incapacity. 

Before collecting Personal Data, your information must be obtained through consent (unless otherwise volunteered). Completion of the Data Processing Consent Form will be deemed under India Privacy law to be sufficient consent to collect, store, process, transfer, and share your Personal Data with third parties or our Service Providers for the purposes set out in this Privacy Policy. 

5. How Have We Shared Your Personal Data for a Business Purpose?

In the preceding twelve (12) months, we have disclosed the following categories of Personal Data for a business purpose with our Service Partners:

  • Category A: Identifiers such as real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address

  • Category B: PI categories such as government-issued identification numbers

  • Category C: Protected classification

  • Category F: Internet or other similar network activity

  • Category J: Non-public education information such as student identification codes used to track continuing education credits

6. How Can You Can Exercise Your Privacy Rights?

If you wish to exercise any of these rights, you may:

If you would like to make a complaint about how we have handled your Personal Data, or to make a complaint about a breach of data protection laws, please email us. We will investigate complaints and will communicate the outcome of the investigation to you after the complaint is made in accordance with applicable law. You may also have a right in some locations to file a complaint with your local data protection authority.

7. How to Make Your Privacy Choices?

  • Emails: If you no longer wish to receive marketing emails from us, you can unsubscribe at any time by following the instructions in our marketing emails. Please note that even if you unsubscribe from marketing emails, you may still receive emails from us related to the Services, such as emails about changes to our policies or about purchases you’ve made from us.

  • Text Messages: If you no longer wish to receive text messages from us, you can unsubscribe at any time by texting “STOP” in response to a text message from either Elevate Nursing LLC or NurseCon LLC.

  • Cookies: Many web browsers enable cookies by default. You can change your cookie settings or disable cookies at any time by updating your browser settings.

  • Do Not Track Signals: We do not currently recognize or respond to automated browser signals regarding tracking, such as “Do Not Track”.

8. Are There Children's Privacy Rights?

The Services are not intended for children, and we do not knowingly collect personal information from individuals under the age of 17. The U.S. Children’s Online Privacy Protection Act (“COPPA”) protects the online privacy of children under 13 years of age or the equivalent age as specified by law in your jurisdiction. Any collection of data will not be processed in any manner that is likely to cause any detrimental effect to children or would aid in targeted advertising at children. If we learn that personal information has been collected from anyone under 17 years of age, or the equivalent in your jurisdiction, then we will take the appropriate steps to cause this information to be deleted. If you believe we might have any personal information from or about a child under 17, please contact us immediately at support@nursecon.com.

9. What Is Our Security Policy?

We take reasonable steps to protect your personal information from loss or unauthorized use, access, disclosure, or destruction. Even so, we can’t guarantee the complete security of any personal information you disclose online. For example, emails sent to or from our Services may not be secure, so you should take care when considering what information you send to us via email. To the extent permitted under applicable law, we assume no liability or responsibility for the loss, disclosure, or destruction of your Personal Data due to errors in transmission, unauthorized access by third parties, or other causes beyond our control. In the event of a personal data breach, notification to affected individuals and to a relevant data protection authority will be conducted in a manner and time prescribed by the applicable jurisdiction.

10. What Is Our Approach to Retention?

We retain your Personal Data for as long as necessary to fulfill the purposes for which it was collected or for other essential purposes, such as complying with our legal obligations, resolving disputes, enforcing our agreement, or otherwise as required or permitted by law. Our collection, use, and disclosure of Personal Data in this Privacy Policy is limited to purposes listed in this Privacy Policy, which are deemed to be reasonable and appropriate.

11. How Do We Approach Third Party Content?

The Sites may make available or provide links to third-party content. We do not control, and we are not responsible for, any third-party content, and this Privacy Policy does not apply to third-party content. We encourage you to review the privacy policies applicable to any third-party content before engaging with it.
